I HEREBY DECLARE THAT: 1. I am physically and mentally able to use this transportation system. 2. I accept the bicycle, all the elements of which it is made up and, the Helmet and Cable Lock which are provided to me in perfect conditions as a rental service. I therefore assume the exclusive responsibility thereon until the time of return and I undertake to return them in the same condition in which I received them. Likewise, I undertake to return the bicycle, all of its components and the helmet within the period of time provided for such return in the same place I received it. 3. I accept the full and complete liability for any injury to myself resulting from the use of the bicycle as well as for any damage caused to third parties. 4. In the event of the crime of unlawful appropriation, or if the bicycle provided to me were returned with a damaged frame owing to misuse, Che Bikes shall be entitled to enforce the rental agreement, with this document constituting an affidavit. In case of theft or lost of the bicycle, or any of the components provided by Che Bikes (Helmet and Cable Lock), I shall be charged a fine of:  Bicycle: $1500 pesos or 100 U$S (that represents 50% of the bicycle price, the other 50% is covered by the Insurance)  Helmet: $290 pesos or 20 U$S  Cable Lock: $80 pesos or 5 U$S 5. I accept that a security deposit of 100 U$S or $1500 or Passport per hire will be required at the beginning of any hire period. This deposit will be returned at the end of the hire period. 6. I undertake to use the bicycle in proper observance of road traffic safety regulations, to use bike lanes whenever possible, to ride exclusively within the City of Buenos Aires and not to ride with other people on the bicycle. 7. I undertake to use all the safety components provided by Che Bikes (Helmet, Cable Lock and Keys) Direct enforcement may be obtained on this affidavit subject to all the relevant effects provided for in section 438 and related provisions of the Code of Civil and Commercial Procedure *
